偵測並防止市場操縱、詐騙及非法活動；</div><div>(c) 維護交易市場及平台運營的完整性；</div><div>(d) 保護合法用戶免受金融犯罪及市場濫用侵害；</div><div>(e) 履行對相關監管機構的申報義務。</div><div><br /></div><h2>3 法律依據</h2><div>MEXC 維持本風險控制框架、本指引及相關程序，係依據您與我們之間的《協議》以及遵守適用的法律義務，包括但不限於：</div><ul style="list-style-type:disc" start="1"><li style="text-align:left"><div>反洗錢（AML）規範；</div></li><li style="text-align:left"><div>身分認證（KYC）規定；</div></li><li style="text-align:left"><div>打擊恐怖主義融資（CFT）規定；</div></li><li style="text-align:left"><div>金融行動特別工作組（FATF）標準；</div></li><li style="text-align:left"><div>歐盟第 5/6 版反洗錢指令（AMLD5/6），建立嚴格的盡職調查、交易監控與用戶驗證義務；</div></li><li style="text-align:left"><div>美國外國資產管制辦公室（OFAC）制裁與觀察名單；</div></li><li style="text-align:left"><div>聯合國安全理事會制裁名單；</div></li><li style="text-align:left"><div>以及其他市場完整性相關法律與法規。</div></li></ul><div><br /></div><h2><strong style="font-weight:bolder">4 風險控制審查觸發因素</strong></h2><div><strong style="font-weight:bolder">4.1 一般規定</strong></div><div>觸發因素係指任何事件、行為或情況，可能對市場完整性、合規要求或平台安全構成潛在風險，包括但不限於交易異常、合約或現貨市場不規則行為、合規或法律問題、或與上幣相關的風險。</div><div>在不限制前述一般性規定的情況下，MEXC 保留絕對權利，於發現任何情況可能合理構成違反適用法律、法規、《協議》或其他適用之 MEXC 政策及/或法律文件時，啟動全面風險控制程序。</div><div>以下為可能觸發風險控制審查機制的事件示例，並於後續條款中進一步說明：</div><div><strong style="font-weight:bolder">4.2 合約交易異常</strong></div><ul style="list-style-type:disc" start="1"><li style="text-align:left"><div>帳號之高級身分驗證程序不完整或仍在審核中；</div></li><li style="text-align:left"><div>涉嫌未經授權進行自動化交易活動的；</div></li><li style="text-align:left"><div>涉及構成市場操縱之行為，包括但不限於自成交（wash trading）、虛假委託（spoofing）、分層掛單（layering）、搶先交易（front-running）及內線交易（insider trading）；</div></li><li style="text-align:left"><div>來自需加強盡職調查（Enhanced Due Diligence）之司法管轄區的交易活動。</div></li></ul><div><strong style="font-weight:bolder">4.3 現貨市場違規</strong></div><ul style="list-style-type:disc" start="1"><li style="text-align:left"><div>未遵守強制身分驗證要求；</div></li><li style="text-align:left"><div>參與協同行情操縱計劃，包括拉抬出貨（pump-and-dump）；</div></li><li style="text-align:left"><div>帳戶受到永久交易限制或制裁。</div></li></ul><div><strong style="font-weight:bolder">4.4 法律與合規違規</strong></div><ul style="list-style-type:disc" start="1"><li style="text-align:left"><div>與犯罪組織、受制裁實體或指定人士有任何關聯（無論在帳戶、交易及/或資金層面）；</div></li><li style="text-align:left"><div>交易模式顯示出洗錢行為、恐怖融資或犯罪收益跡象；</div></li><li style="text-align:left"><div>涉及非法活動所得資產，包括但不限於網路犯罪、勒索病毒、毒品交易或市場操縱（例如拉地毯計劃 rug pulls、拉抬出貨 pump-and-dump）；</div></li><li style="text-align:left"><div>帳戶受到有效司法命令、監管指令或執法機構要求。</div></li></ul><div><strong style="font-weight:bolder">4.5 市場完整性違規</strong></div><ul style="list-style-type:disc" start="1"><li style="text-align:left"><div>未公開披露與代幣發行方或專案團隊之關聯；</div></li><li style="text-align:left"><div>涉嫌與上幣有關之可疑充值活動；</div></li><li style="text-align:left"><div>交易模式顯示出圍繞上幣事件的協同市場操縱行為。</div></li></ul><div><strong style="font-weight:bolder">4.6 確認事項</strong></div><div>上述示例僅供理解之參考，並非完整列舉。 MEXC 可能於其他（非窮盡性）情境下啟動風險控制審查。</div><div><br /></div><h2><strong style="font-weight:bolder">5 禁止的交易行為示例</strong></h2><h3><strong style="font-weight:bolder">5.1 一般規定</strong></h3><div>禁止之交易行為，係指任何並非透過 MEXC 所明確提供之方式進行，且可能影響市場公平性、製造誤導或虛假的市場現象或資訊，或藉由濫用規則而獲取不當利益之行為。以下列舉部分禁止之交易行為，並於後續條款加以說明。</div><h3>5.2 未經授權之自動化或異常交易活動</h3><div>指任何可能對市場秩序、公平性或交易系統正常運作造成不利影響之交易行為，包括但不限於：</div><div>5.2.1 使用任何未經授權之自動化及／或程式化方式（包括但不限於工具、腳本、深度連結、機器人〔bots〕、爬蟲〔spiders〕）進行下單或執行交易；</div><div>5.2.2 使用異常裝置、網路或 IP 位址，或其他技術或非技術手段以隱匿身分或交易活動；</div><div>5.2.3 掃描或探測未公開之 API，或嘗試發現隱藏端點；</div><div>5.2.4 使用非標準協定序列或其他方式試圖規避監測；</div><div>5.2.5 冒充多個客戶身分、偽造裝置 ID、使用者代理（user-agent）或會話識別碼；</div><div>5.2.6 提交並取消大量訂單以操縱訂單簿（例如虛假委託〔spoofing〕、報價塞單〔quote-stuffing〕或訂單轟炸〔order-bombing〕）；</div><div>5.2.7 協同使用代理伺服器／VPN／分散式網路以隱匿身分或規避限制。</div><h3>5.3 市場操縱</h3><div>指任何造成市場活動或價格趨勢虛假或誤導性外觀之行為，包括但不限於：</div><div>5.3.1 拉抬出貨（pump and dump）、自成交（wash trading）、自我交易、搶先交易（front-running）、報價塞單、虛假委託或分層掛單，以及關聯或附屬帳號間之協同交易；</div><div>5.3.2 利用資金或流動性優勢等刻意行為，以人為方式抬高、壓低或其他方式操縱任何數位資產之價格。</div><h3>5.4 內線交易或搶先交易</h3><div>指利用重大非公開資訊，或基於具特權或提前取得平台資訊者之提示、洩漏或指令進行交易之行為，包括但不限於：</div><div>5.4.1 與內部人員、員工、關聯方或掌握交易或上幣活動提前資訊者協同行動；</div><div>5.4.2 在已知大型客戶或平台訂單執行前預先下單（即「搶先交易」）；</div><div>5.4.3 使用從員工、合作夥伴或供應商處非法取得或洩露之資訊以獲取不當交易優勢。</div><h3>5.5 規避持倉上限</h3><div>指透過多個帳號、子帳號或第三方中介機構分拆或分散持倉，以累積超過平台單一用戶持倉上限之行為，包括但不限於：</div><div>5.5.1 關聯或附屬帳號間協同交易，以規避保證金、槓桿或持倉限制；</div><div>5.5.2 使用多重 KYC 身分或資金來源以隱匿最終受益人；</div><div>5.5.3 為規避交易或持倉控制而於帳號或實體間轉移資金。</div><h3>5.6 濫用規則及不當套利</h3><div>指任何意圖利用 MEXC《用戶協議》、規則、系統或政策以取得不當利益之行為，包括但不限於：</div><div>5.6.1 使用多個帳號或第三方帳號以規避適用之交易規則、指令、限制，或進行不當套利；</div><div>5.6.2 多帳號協同交易，以施加過度市場影響力或操縱市場價格、深度或流動性；</div><div>5.6.3 進行對沖或跨市場套利，利用規則差異或系統漏洞從事無風險套利，涉及非法資金或導致市場操縱、破壞正常交易環境。</div><h3>5.7 涉及場外法幣充值與提現交易之詐騙活動</h3><div>指用戶於場外（OTC）法幣充值或提現過程中，涉嫌進行詐騙或非法資金活動之行為，包括但不限於：</div><div>5.7.1 使用被盜用、冒名、未經授權或其他異常之銀行帳戶、支付工具、電子錢包或身分資訊進行交易；</div><div>5.7.2 參與、協助或利用 OTC 管道從事電信詐騙、洗錢中介（money mule）、社交工程詐騙、非法資金集資或其他犯罪或禁止活動；</div><div>5.7.3 使用資金來源或用途異常、與用戶身分特徵、風險概況、聲明用途或交易行為不符之資金進行交易；</div><div>5.7.4 涉及異常資金流動模式，包括但不限於快速資金流入／流出、無正當經濟目的之大額或高頻交易、不匹配或異常交易對手、資金流向不透明；</div><div>5.7.5 其他破壞資金安全管理、企圖規避風控或涉嫌非法金融活動之行為。</div><h3>5.8 涉及 P2P 交易之詐騙活動</h3><div>指用戶於 P2P（點對點）交易過程中涉嫌進行詐騙或非法資金活動之行為，包括但不限於：</div><div>5.8.1 使用被盜用、冒名、未經授權或遭入侵之銀行帳戶、支付工具或身分資訊進行 P2P 交易；</div><div>5.8.2 參與、協助或透過 P2P 交易進行電信詐騙、社交工程詐騙、洗錢中介、套現操作或其他非法資金流動；</div><div>5.8.3 提供虛假付款憑證、偽造轉帳紀錄或誤導交易對手釋放資產而未實際付款；</div><div>5.8.4 以脅迫、恐嚇、欺騙或誘導方式迫使交易對手釋放資產或退款，或從事惡意拒付／支付爭議行為；</div><div>5.8.5 使用資金來源或用途異常、與用戶聲明目的、風險概況、財務能力或交易模式不符之資金進行交易；</div><div>5.8.6 任何企圖規避平台風控、破壞正常交易秩序或涉嫌非法金融活動之行為。</div><div><h3>5.9 確認事項</h3><div>為免歧義，禁止的交易行為包括但不限於<strong style="font-weight:bolder">自成交與洗單、市場操縱與虛假掛單、過度下單活動，以及其他可能受適用法律、法規及金融慣例禁止之不規則交易行為。</strong></div><div>MEXC 擁有全權及最終裁量權，以判斷任何行為是否構成禁止交易行為，並可採取其認為適當之措施，包括但不限於暫停、限制或終止帳號、沒收收益，及向監管機構舉報。舉例而言，包括但不限於：</div><div>上述示例僅為協助理解之參考，並非完整列舉。MEXC 保留權利，就任何其認為違反本指引、協議或適用法律法規之行為進行調查、判定及採取行動，無論該行為是否於前述示例中明確列出。</div></div><div><br /></div><h2><strong style="font-weight:bolder">6 提幣限制與帳戶限制</strong></h2><div>MEXC 可於下列情況下，施加臨時或永久性提幣限制及/或帳戶限制：</div><div>(a) 在認證憑證修改後（如密碼或雙重驗證重置）設置的強制安全冷卻期；</div><div>(b) 啟動自動化風險控制機制時；</div><div>(c) 對新授權的提幣地址實施加強安全協議時；</div><div>(d) 依據監管要求或執法機關指令時。</div><div>大部分限制將維持 24 小時；但 MEXC 保留全權酌情決定，縮短、延長或永久實施該限制，視實際情況及風險考量而定。</div><h2>7 審查與處理程序</h2><div><strong style="font-weight:bolder">7.1 監管權限與執法權</strong></div><div>一旦發現疑似違規行為，MEXC 有權在未事先通知受影響用戶的情況下行使其執法權，包括但不限於： (a) <strong style="font-weight:bolder">強制報告要求</strong>：要求用戶提供完整文件以解釋相關交易活動； (b) <strong style="font-weight:bolder">訪問限制</strong>：暫停或終止用戶對平台服務及交易功能的使用； (c) <strong style="font-weight:bolder">交易限制</strong>：實施下單限制、持倉調整限制，以及強制平倉程序； (d) <strong style="font-weight:bolder">資金限制</strong>：在調查完成前，限制提款及存款； (e) <strong style="font-weight:bolder">帳號關閉與資產沒收</strong>：依法可行的情況下，終止用戶帳號並沒收剩餘資產； (f) <strong style="font-weight:bolder">其他補救措施</strong>：依據適用業務規則與監管要求，採取任何必要之執法行動。</div><div><strong style="font-weight:bolder">7.2 審查、調查與評估</strong></div><div>若發現潛在可疑活動，或觸發風險控制機制，MEXC 可先進行初步評估，以判斷用戶行為是否違反適用法律、法規、《用戶協議》、本《指引》或其他政策。 在初步評估後，MEXC 可能會基於以下因素作出決定：</div><div>(a) 違規性質與嚴重程度；</div><div>(b) 違規行為是獨立進行還是屬於協同操作；</div><div>(c) 執法措施是否與違規嚴重性相稱。</div><div>為避免疑義，每一案件均將基於具體事實與情況單獨審查，MEXC 保留在其自行決定下採用不同調查、評估與執法方式的權利。</div><div><strong style="font-weight:bolder">7.3 補救措施與制裁</strong></div><div>MEXC 可於調查完成後實施全面補救措施，包括： (a) 長達 180 天的帳號限制（如適用其他政策，則可能更長）； (b) 交易回滾與不當收益的追繳； (c) 配合監管凍結資產； (d) 對於嚴重違規者，永久禁止使用平台服務。 補救措施將依個案情況而異；若涉及群體性濫用，限制期可能更長。</div><div><strong style="font-weight:bolder">7.3.1 加強監控期（30 天觀察期）</strong></div><div>具有可疑交易模式的帳號，將被納入三十（30）天的加強監控期。此舉可全面評估用戶行為並降低誤判風險。MEXC 保留根據情況延長該觀察期的權利。 在此期間，MEXC 可能採取以下行動：</div><ul style="list-style-type:disc" start="1"><li style="text-align:left"><div>追蹤用戶是否嘗試透過新帳號或既有帳號進行交易，特別是與可疑帳號具有相同 IP 位址或類似交易模式者；</div></li><li style="text-align:left"><div>識別多帳號之間的協同交易行為，無論其發生於過往或觀察期間內，若該行為可能影響市場價格。</div></li></ul><div><strong style="font-weight:bolder">7.3.2 延長限制期（180 天限制）</strong></div><div>涉及協同違規、高風險活動或有重大合規問題的帳戶，可能面臨最長 180 天的限制（其他政策適用時，限制期可延長）。此舉既能發揮威懾作用，也能為監管協調提供足夠時間。</div><div><strong style="font-weight:bolder">7.3.3 交易回滾</strong></div><div>為維護市場完整性並保護合法用戶，MEXC 保留撤銷下列交易的權利：</div><div>(a) 違反適用法律、法規、《用戶協議》、本《指引》及／或其他 MEXC 政策之交易；</div><div>(b) 對其他用戶的交易體驗及正常交易秩序造成影響之交易。</div><div>交易回滾決定將基於完整交易數據與模式分析後作出。受影響用戶可透過既有程序提出申訴。</div><div><strong style="font-weight:bolder">7.4 申訴、複查與解決</strong></div><div><strong style="font-weight:bolder">7.4.1</strong> 受執法措施影響之用戶可採取以下方式提出異議： (a) 提交正式申訴及完整佐證文件； (b) 依照既定程序申請內部複查； (c) 提供與執法決定相關之補充證據。</div><div><strong style="font-weight:bolder">7.4.2</strong> 受帳號審查之用戶，必須依 MEXC 指示完成必要驗證程序，包括進階身分驗證及提交額外文件。</div><div><strong style="font-weight:bolder">7.4.3</strong> 受帳號限制之用戶，可依以下步驟申請解除：</div><ul style="list-style-type:disc" start="1"><li style="text-align:left"><div><strong style="font-weight:bolder">網頁端</strong>：<a target="_blank" href="https://www.mexc.com/" rel="noopener noreferrer">首頁</a>下方 → 幫助中心 → 帳號風險審查 → 按照頁面指引完成表單；</div></li><li 不會披露內部風險控制機制或審查流程的詳細資料，且無法保證任何審查的持續時間或結果。</h3><h2>8 多帳號操縱：案例研究</h2><div><strong style="font-weight:bolder">關聯帳號的可疑活動</strong> 多個帳號出現明顯協同行為，進行違反平台規則的交易。依據以下證據，這些帳號被標記為疑似操縱：</div><ul style="list-style-type:disc" start="1"><li style="text-align:left"><div>使用相同 IP 位址操作；</div></li><li style="text-align:left"><div>下單時間高度同步。</div></li></ul><div><strong style="font-weight:bolder">案例</strong> 2025 年 5 月 30 日 11:06:18（UTC+8），多個關聯帳號同時於 <strong style="font-weight:bolder">FLOCKUSDT</strong> 開倉，且進場價格相同，試圖規避平台的持倉風險限制。該群帳號的總交易量約佔當時期總交易量的 50%，構成疑似市場操縱。 2025 年 5 月 31 日，這些帳號被限制並納入 30 天觀察期。</div><div><strong style="font-weight:bolder">持倉風險限制</strong> 持倉風險限制是合約交易中的一項風險管理措施，用於限制單一用戶或帳號所能持有的最大倉位。平台會針對每一交易對設定最大倉位上限，以防止過度風險集中於少數市場參與者，並減少市場操縱風險。</div><div><br
